Terms of service

These Terms of Service (the “Terms”) are a binding legal agreement between you and Ishan Khetarpal, an individual operating as a sole-proprietor independent service (the “Operator,” “we,” “us,” or “our”), governing your access to and use of the website at khetarpalteachescoding.com and all related features, content, and services (collectively, the “Site”). Contact: info@khetarpalteachescoding.com.
By creating an account, accessing, or using the Site, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Site. If you are using the Site on behalf of a minor, you accept these Terms on their behalf and are responsible for their use.
1. Eligibility and age requirements
- You must be at least 13 years old to use the Site. The Site is not directed to and may not be used by children under 13. We do not knowingly collect personal information from children under 13; if we learn that we have, we will delete the account.
- If you are under 18 (or the age of majority where you live), you may use the Site only with the involvement, consent, and supervision of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use, including any charges.
- By using the Site, you represent and warrant that you meet these requirements, that all information you provide is accurate, and that you are not barred from using the Site under any applicable law.
- The Site is an independent service. It is optional, is not required for any class or coursework, and is not affiliated with, endorsed by, or recommended by any school, school district, or school system.
2. The service
The Site is an educational tool that uses artificial intelligence to generate coding challenges, grade submissions, provide hints, and operate an AI tutor for learning Python and Java. The Site is provided for personal, non-commercial, educational purposes only. We may add, change, suspend, or remove features at any time without notice. We do not guarantee that any particular feature, challenge, language, or capability will remain available.
3. Accounts and security
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to provide accurate information, to keep your account secure, and to notify us promptly at info@khetarpalteachescoding.com of any unauthorized use.
- You may not share, sell, or transfer your account, create accounts by automated means, or maintain more than one account to evade limits, suspensions, or billing.
- We may suspend or terminate accounts, refuse service, or remove content at our discretion, including for suspected abuse, fraud, security risk, or violation of these Terms.
4. AI-generated content — important disclaimer
The challenges, grades, hints, explanations, tutor messages, and other output on the Site are generated by artificial intelligence. You understand and agree that AI output:
- can be incorrect, inaccurate, incomplete, outdated, biased, or misleading, and may contain factual or coding errors, insecure code, or non-working solutions;
- may, despite our filtering efforts, occasionally produce content that is offensive, inappropriate, or objectionable; and
- is not authoritative and is not a substitute for verified instruction, professional advice, or professional code review.
You acknowledge that you accepted the AI-risk acknowledgement at signup. You use AI output entirely at your own risk and are solely responsible for reviewing, testing, and verifying any code or information before relying on it. We are not responsible or liable for any AI-generated content or for any decision you make or action you take based on it. Do not submit code, data, or text that is confidential, sensitive, regulated, or that you are not permitted to share, as AI requests are processed by a third-party provider (see Section 11).
5. Acceptable use
You agree not to, and not to allow anyone else to:
- use the Site for any unlawful, harmful, fraudulent, or abusive purpose;
- submit, generate, or attempt to elicit content that is illegal, harassing, hateful, sexually explicit, violent, defamatory, or that infringes others’ rights;
- attempt to bypass, disable, or interfere with security, rate limits, billing, authentication, or usage controls;
- probe, scan, overload, disrupt, reverse engineer, scrape, or gain unauthorized access to the Site, its infrastructure, or other users’ data;
- use bots, scrapers, or automated means to access the Site or to harvest the AI provider’s output (e.g., to train or build a competing model or service);
- resell, sublicense, or commercially exploit the Site or its output without our written permission; or
- use the Site to violate academic-integrity rules — you are responsible for complying with the policies of any school or institution you are part of.
6. Subscriptions, billing, and free trial
- Free trial. The Site may offer a free trial. Unless you cancel before the trial ends, your subscription will automatically begin and the applicable fee will be charged. Trial eligibility, length, and terms may change, and trials are limited to one per person.
- Price. Paid access is currently $22 per month. Pricing, plans, trial terms, and features are subject to change at any time; see the Pricing page for current details. We will apply changes prospectively and, where required by law, give notice.
- Auto-renewal. Subscriptions renew automatically each billing period until canceled. By subscribing, you authorize recurring charges to your payment method until you cancel.
- Payments & merchant of record. Billing is processed by Creem, our third-party merchant of record, under Creem’s terms. You provide your payment details directly to Creem; we never see or store your full payment information. Applicable taxes may be added.
- Cancellation. You may cancel at any time through the billing portal or by contacting us. Cancellation stops future renewals; you retain paid access through the end of the current paid period.
- Refunds. Except where required by law, all fees are non-refundable and we do not provide refunds or credits for partial periods, unused access, or downtime.
- Failed payments. If a charge fails, we may suspend or downgrade your access until payment is resolved.
7. Your content and intellectual property
- Your content. You retain ownership of the code and text you submit (“Your Content”). You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display Your Content as needed to operate and improve the Site, including sending it to our AI provider to generate responses. You represent that you have the rights to submit Your Content.
- Our content. The Site, its design, code, branding, and original materials are owned by the Operator and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Site for its intended educational purpose. No other rights are granted.
- AI output. AI-generated output may not be unique to you and may be similar to output provided to others. We make no claim of ownership over, and provide no warranty of any rights in, AI output, and we make no representation that it is original or non-infringing. Subject to these Terms and the AI provider’s terms, you may use AI output for your personal learning.
8. Third-party services
The Site relies on third parties including Anthropic (AI), Creem (payments), DigitalOcean (hosting), and Cloudflare (DNS). Your use of features powered by these services may be subject to their terms, and we are not responsible for their acts, omissions, availability, or content. 9. Availability — no warranty of uptime
The Site is provided on an “as available” basis. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that it will be available at any particular time. We are not liable for any downtime, interruption, maintenance, degraded performance, data loss, or unavailability, whether caused by us, our providers, your equipment or network, or events beyond our control. We may modify, suspend, or discontinue the Site, in whole or in part, at any time without notice or liability. You are responsible for keeping your own copies of any work you wish to retain.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND OUTPUT (INCLUDING AI OUTPUT) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE OR ITS OUTPUT WILL MEET YOUR REQUIREMENTS, BE ACCURATE OR RELIABLE, OR BE FREE OF ERRORS, BUGS, VIRUSES, OR HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ITS OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE THEORY OF LIABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US FOR THE SITE IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND US.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, Your Content, your violation of these Terms or any law, or your infringement of any third-party right.
13. Termination
You may stop using the Site and close your account at any time. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms or for any reason or no reason. Upon termination, your right to use the Site ends immediately. Sections that by their nature should survive (including Sections 4, 7, and 9–17) survive termination.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at info@khetarpalteachescoding.com and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Montgomery County, Maryland, and you consent to personal jurisdiction and venue there. To the extent permitted by law, you and the Operator each waive any right to a jury trial and agree that any dispute will be brought only in an individual capacity and not as a plaintiff or class member in any class or representative action. Any claim must be brought within one (1) year after it arises, or it is permanently barred, except where applicable law prohibits such a limit.
15. Changes to these Terms
We may update these Terms from time to time. The “Effective date” above reflects the latest revision. Material changes will be announced on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Site.
16. General
- Entire agreement. These Terms and the Privacy policy are the entire agreement between you and us regarding the Site and supersede any prior agreements.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be enforced to the maximum extent permissible.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them freely, including in connection with a transfer of the Site.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
- No agency. No partnership, employment, or agency relationship is created by these Terms.
